The Plaintiffs commenced this Action against Verizon Northwest Inc. (“VNI”) and other Verizon entities (“Other Named Verizon Entities”) on behalf of themselves and all other Verizon customers in the United States who, at any time between December 1, 1996, and November 16, 2009 paid for the *69 Service but were not provided with the number of the last incoming call and/or given the opportunity to have that call automatically returned. Plaintiffs allege that VNI and the Other Named Verizon Entities misrepresented the capabilities of the *69 service and improperly charged customers in instances where it failed to provide a dialable number for the last incoming call or to automatically return the call. Based on this alleged conduct, Plaintiffs assert claims for violations of consumer protection statutes, negligent misrepresentation, fraudulent misrepresentation and concealment, breach of contract, and tariff violations. VNI and the Other Named Verizon Entities deny these allegations and any liability to Plaintiffs and/or the Settlement Class, but VNI is entering into the proposed Settlement to avoid the burden, delay and expense of continued litigation. The Court has made no ruling on the validity of Plaintiffs’ claims, and the proposed settlement does not constitute an admission of any wrongdoing whatsoever by VNI or the Other Named Verizon Entities.
